The National Supervisory Authority for Personal Data Processing carried out an investigation to Petrom S.A. where it was observed that the persons' access to private/public places was monitored by video surveillance, purpose not being notified to the authority.

In the mean time, it was observed that the activity of data subject information was not carried out for the use of video cameras.

These deeds were sanctioned with the contraventional fine of 2.700 RON.

In this context, we emphasize that a person's image is personal data, and the recording, storing, transmitting or communication of data consisting of images and sounds are considered to be processing operations.

Processing of personal data by using video surveillance systems is made by respecting the principle of proportionality of the legitimate purpose also in the case in which other prevention, protection and security measures are proved to be insufficient and/or inapplicable.

We emphasize that every legal entity that installs video surveillance cameras must notify the National Supervisory Authority, before starting the processing.
