The National Supervisory Authority for Personal Data Processing carried out an investigation at Garantibank Internaţional N.V. S.A. Romania branch, following a complaint.
During the control it was observed that the phone number of a former client was used to transmit SMS messages, without his/her unequivocal and express consent.
This represents an unlawful personal data processing, offence specified in the provisions of Law no. 677/2001, which was sanctioned with a fine of 1500 RON.
In this context, we emphasize the fact that a person's phone number is personal data.
Each person is entitled to oppose at any moment, on founded and legitimate ground concerning his/her situation, that his/her personal data to be processed, if there are no legal dispositions opposing it. Exercising the right to object is realised by sending a written letter, dated and signed, to the concerning legal person, which has to reply in 15 days.
