Interinstitutional cooperation in order to combat “spam”

The National Supervisory Authority for Personal Data Processing (ANSPDCP) organized on Thursday, the 5th of December 2013, a debate with the Ministry for Information Society (MSI) and the National Association of the Internet Service Providers (ANISP) to which Mrs. Anca Opre, the president of ANSPDCP, Mr. Bebe Viorel Ionică, state secretary from MSI and Mr. Radu Ghidiceanu, the president of ANISP.

Within this meeting a series of concrete ways of interinstitutional cooperation in order to ensure an efficient legal protection of the users of electronic communications service against the so-called “spam” were established. The three parties participating at the reunion welcomed the proposal of applying a sanction consisting in blocking the access to Internet, by cooperating with the Internet service providers, including via ANISP in case of transmission of unsolicited commercial communication repeatedly and to a high number of addresses of electronic mail and, respectively, in case of illegal sale of databases containing this kind of personal data, based on a decision of MSI, according to the provisions of Law no. 365/2002 and to the coercive measures imposed by ANSPDCP, according to the dispositions of Law no. 506/ and of Law no. 677/2001.

The National Supervisory Authority for Personal Data Processing, according to Law no. 506/2004, may impose fine in case of transmission of commercial communications without the prior express consent of the recipient or in other illegal conditions, in the amount of 5.000 to 100.000 lei and for the companies with a turnover of over 5.000.000 lei in the amount of 2% of its turnover.
